ARCCA ability to testify
ARCCA has NOT been cleared to testify yet. Judge Cannone denied the motion to exclude ARCCA based on the defenses lies to the court/judge & jury in trial 1. However, she stated "those witnesses can testify AS LONG AS COUNCIL COMPLIES WITH THEIR RECIPROCAL DISCOVERY OBLIGATIONS". Brennan has been pushing for this discovery for months and still has not recieved it. Specifically, what was ARCCA tasked with doing and why were they only given limited data (probably to come to a predetermined conclusion). If the defense is unable to provide the communications from the DOJ to ARCCA or from the defense to ARCCA outlining the request they can still be prohibited from testifying. It certainly seems like either the defense/DOJ or both are hesitant to provide that discovery, possibly because it will show the true "murky" relationship which could open an even bigger bag of worms. I cant imagine that Judge Cannone will be so lenient with allowing experts that dont meet discovery obligations this time around since the defense basically spit in her face when she allowed it last time.
